Today the 26th of November 2023 ,the Nigerian Appeal Court sitting in Lagos affirmed the victory of Hon.Okey Anthony Mba, the house member representing Nkanu East at the Enugu State Assembly. Justice Ugo PJ Kano, Justice B. B. Aliyu and Justice O. O. Goodluck nullified the earlier judgement of Justice Adie Attoe at the tribunal.
Earlier in September the Enugu State Governorship and House of Assembly Tribunal sitting in Enugu, delivered judgement on the petition filed by the Labour Party candidate, Okwudili Nnaji against Hon. Okechukwu Anthony Mba of the PDP. The judgment delivered by the panel led by Hon. Justice Adie Attoe Onyebueke declared the election inconclusive citing controversial results from some polling units in four wards, namely: Akpofu/Isienu Amagunze, Owo, Ihuokpara, and Amafor Ugbawka.
It is interesting to note however, that Hon. Okey Mba won the election with about 16,700 votes, and the outstanding votes in the polling units of the 4 wards are not up-to that, and if all are given to the LP Candidate he wont still be able to overturn the Mba’s victory margin. Hence, political and legal pundits described the decision of the Tribunal last two months as a mere academic exercise, because the margin of lead is more than cancelled votes that’s why the decision of the Appeal Court today was not surprising to many.
